Florida man involved in road rage incident makes first court appearance

KIMBALL, Neb. A Florida man accused of a road rage shooting incident on the interstate near Kimball made his first court appearance today.

47 year old Kevin Austin sat quietly as charges against him for the July 4th incident were read in Kimball County Court.

According to the previous arrest affidavit, a passenger in the victim vehicle admitted to his driver honking the horn while flashing the headlights at the vehicle Austin was riding in. Nebraska State Troopers were told as the vehicles traveled next to one other, the driver of the victim vehicle started to roll down her window to make an obscene hand gesture to Austin when the door glass suddenly shattered.

Austin confirmed most of that story to Wyoming Troopers, but indicated a drink was thrown at them from the victim's window before he fired a gun. The driver of Austin’s vehicle said she wanted to stop following the shooting incident, but Austin would not let her.

If convicted, Austin faces a potential penalty of up to 20 years in prison on the assault charge and five to 50 years in prison for the weapons charge.

Austin’s preliminary hearing was set for Tuesday, July 24th, starting at 8:30am.

Bond in the case was set at $50,000 with a ten percent provision.
