Weighing The Costs

Sutherland village officials weigh repair cost against moral accountability, when determining payment strategies to Associate Pool Builders.

The Board of Trustees expressed severe distrust of contractual obligations - fearing that fulfilling the contract's entire cost would prevent Associate Pool Builders from repairing problems the Board considers to be breach of warranty.

Sutherland City Attorney Philip Pierce presented the stipulations from one clause in the contract, stating that payments can be legally withheld upon the owner's assessment.

However, the board voted to go forward with the payment of approximately $217,000, of the remaining $420,000 in costs.

Tom Werblow , Village Engineer, Sutherland, says, "That was a payment that was applied for in April and up until April there had been some disagreements about how well the work was going and so the village felt they needed to discontinue payment at that time."

Subsequently we had a meeting just recently and were able to work through some issues. This is a payment they felt like they could make now understanding the contractor's point of view, and the contractor understanding the village's point of view as well.

Problems that Associate Pool Builders are still being held accountable for include cracks within the pool and on the pool deck, and damages due to flooding.
